    Personal Injury Law: General
    Personal injury law is based in torts. Broadly defined, a tort is a harmful act or failure to act for which the law provides a remedy. There are many different kinds of torts. Physically injuring someone is a tort; so is damaging a person's property or character, or wrongly denying someone his or her liberty. The basic principle of tort law is that injured persons should be compensated by those responsible for their injuries. Thus, a victim of a tort has the right to sue the tortfeasor (the person committing the tort) for damages. Though often confused, torts and crimes are separate in the law. A tort is a civil wrong against an individual that exposes the tortfeasor to liability. A crime is a wrong against society or the state and is punishable by incarceration or a fine. Some acts, however, can be both a tort and a crime. For example, someone who uses force to cause bodily injury commits a tort known as battery and is liable to the victim for damages. Battery also is a misdemeanor under Texas law, punishable by up to one year in prison and/or a fine of up to $4000. Thus, a person could be prosecuted and convicted of the crime of battery, and also face a civil lawsuit brought by the victim. This chapter outlines general tort principles and theories of recovery, including products liability law.     Elder Law
    Elder law is one of the fastest-growing specialty areas of legal practice today. As recently as ten years ago, almost no one would have described his or her legal practice as an elder law practice, because most lawyers assumed that the concerns of elderly clients were indistinguishable from the interests of any other group. Because few lawyers focused their practices on senior citizens, many seniors felt their unique concerns were ignored by the legal profession. All this is changing rapidly. As the average age of Americans rises, society is becoming increasingly aware of the unique problems facing elderly people, as well as the professional opportunities available in serving them. As senior citizens take a more active role in asserting their rights, an increasing number of the elderly have sought legal representation from lawyers sensitive to their needs. Elder law is not a well-defined area of legal specialization. Elder law borrows from many other areas, such as health law, probate, estate planning and trusts, family law, civil rights, and even consumer protection. Each of these areas is discussed fully in separate chapters of this

Rural law enforcement goes on line ... for free by Attorney General John Cornyn More than 90% of law enforcement agencies stand guard against crime in rural America. The job is not getting any easier. Violent offenses in rural counties are increasing while overall crime rates are dropping throughout the nation. Rural sheriffs and police chiefs responding to my survey, Gangs in Texas: 1999, noted more gang "mobility," or city gangs traveling into smaller jurisdictions to commit crimes then returning home. About two-thirds of the counties in the United States have too few officers to cover too much ground. Often, rural agencies have to fight violence with smaller budgets, older equipment and fewer educational resources than urban agencies have. Until now, the rapidly developing Internet technology had also left many rural law enforcement agencies behind. Those in sparsely populated areas often have to pay expensive long distance charges for Internet connections. To enhance the crime-fighting ability of rural law enforcement, the National Center for Rural Law Enforcement now offers qualified agencies a free Internet connection. The eligible agencies are those serving counties with up to 50,000 residents or cities with 25,000 residents or fewer. According to the1990 Census, agencies in 80% of the 254 Texas counties and 94% of the 1,193 cities may qualify. About 100 Texas law enforcement agencies already connect to the Internet via the National Center's server.

Policing the web for child pornography by Attorney General John Cornyn Criminals today are breaking into their victims' homes, not on the telephone or by a knock on the door, but through computer modems. Pornographers in particular have found 113 million new potential victims for their crimes via the Internet. Purveyors of smut have found it convenient to use the Internet to transmit or trade pornographic images of minors from one user to another. Many children use the Internet daily to play games, complete homework and write e-mail messages. The ease of data transfer increases the probability that these innocent minors may also be exposed to illegal pornographic material. Increasingly, local Texas law enforcement officials are also called upon to use the Internet to break certain cases. Officers in the Corpus Christi Police Department reported to the Houston Chronicle (August 9, 1998) that five times in the last two months law enforcement agencies in other states have warned them of possible Internet sexual predators under their jurisdiction. This is why I am offering help to local law enforcement agencies from a specialized crime fighting unit within my Prosecutor Assistance Division. Governor George W. Bush's Criminal Justice Division has funded this unit with a grant to combat criminal activity targeting children on the Internet. Now, law enforcement officials statewide can turn to my office for help when they have limited resources, find conflicts of interest or simply have a need for specialized expertise on these crimes.
