Email chronicle@chronohio.com By Eric Resnick The most anti-gay law in Ohio, now being reviewed by the state’s highest court, might owe its birth to the repeal of a sodomy law 30 years ago. The importuning law makes it a crime to ask someone for gay or lesbian sex if it would offend them. It is unique to Ohio, and its origin is linked to a major event in Ohio’s legislative history. House Bill 511, passed in December 1972, completely overhauled Ohio’s criminal codes. The first real change to Ohio’s criminal law since 1840, it is the largest bill ever passed by the state. Lawmakers worked on the bill for nearly seven years. Part of H.B. 511 was the repeal of Ohio’s sodomy law criminalizing homosexual acts between consenting adults. With that, Ohio became one of the earliest states to decriminalize homosexuality, but behind-the-scenes maneuvering and the political climate may have left us with the importuning law. The anti-gay section of the importuning law, which is section 2907.07 of the Ohio Revised Code, is only one of its three parts. The other two deal with sexual solicitation of children by adults. These are also covered by other sexual offenses created by H.B. 511. Thus, the section prohibiting same-sex inquiries is the only uniquely operational part, and the part that is now under constitutional scrutiny by the Ohio Supreme Court.

In 1996, Ohio adopted a comprehensive tort reform act that repealed, amended, or added more than 100 sections of the Ohio Revised Code, including many relevant to medical malpractice. Am. Sub. H.B. 350, 121st Leg. (1996). The Ohio Supreme Court held this act to be unconstitutional in its entirety in State ex rel. Ohio Academy of Trial Lawyers v. To resolve the ambiguity created by a mass of invalid legislation, the General Assembly passed Sub. S.B. 108, 124th Leg. Statutes of Limitations Every action for medical malpractice must be brought within one year after the cause of action accrues. Ohio Rev. Code Ann. § 2305.11(B)(1) (Banks-Baldwin Supp. 2002). A cause of action for medical malpractice accrues when the claimant discovers or, in the exercise of reasonable care and diligence, should have discovered the resulting injury, or when the physician-patient relationship for that condition terminates, whichever occurs later.   • Denison University expects its students and organizations to abide by the Denison community code of conduct which states that members of the Denison community are expected to treat other persons with dignity, respect, mutual consideration and to respect and preserve property, and to act with due regard for the health and safety of others.
  • Failure by individuals and/or organizations to comply with the University Anti-Hazing policy constitutes a major violation of the Student Code of Conduct and may result in the following sanctions for the organization and/or individuals, but is not limited to: ultimate probation, deactivation, suspension, expulsion, withdrawal of recognition and suspension of operations.

C. William Swank Program in Rural-Urban Policy Rural crime has always been a concern for farm owners, but current social and political conditions have created new worries about harm to farm property. Population increases in agricultural areas and opposition to agricultural production practices are a few of the current circumstances exposing farm owners to the threat of harm to farm property. These conditions lead to incidents of trespass, vandalism, and other acts that harm livestock and other farm property. Ohio law addresses many of the questions raised about farm security. Is there any recourse against four-wheelers who destroy farm crops? Is it a crime to harm or kill livestock? How can a farm owner be compensated for harm caused by vandals? This fact sheet presents the Ohio laws that answer these and other questions about farm security. When addressing acts of harm to farm property, it is important to understand the difference between criminal and civil actions. This fact sheet begins with an explanation of criminal and civil actions and separately addresses criminal and civil laws regarding farm security issues. The fact sheet concludes with recommended actions an agricultural landowner can take to maximize the protection of Ohio law and reduce or prevent farm security problems.

Argued: March 17, 1998 Decided and Filed: April 8, 1998 Before: BOGGS, NORRIS, and MOORE, Circuit Judges. COUNSEL ARGUED: ON BRIEF: OPINION BOGGS, Circuit Judge. Wanda Portis's employment discrimination case, brought under state and federal law, was dismissed on summary judgment by the district court. The district court relied on , 825 F.2d 946 (6th Cir. 1987) (en banc), cert. denied , 487 U.S. 1204 (1988). However, it misapprehended the fact that Leaman only bars suits against state officers and employees, not suits against the state itself. Therefore, we reverse in part and remand for further proceedings. I A Portis worked for the State of Ohio as a juvenile-corrections officer. She claims that her supervisor, Raymond Bowman, "made advances of a sexual and harassing nature" toward her, which she rejected. Because of this, Portis says, she was verbally abused by co-workers, sometimes in front of youth offenders, and her authority was undermined as a result. Portis's most consequential allegation is that she was "left alone with violent, youth offenders in contradiction of stated policy," and that she was assaulted by a youth offender in September 1994.
