Approved Jurisdiction Policy and Procedures

Under the approved jurisdiction policy, New York attorneys who attend out-of-state courses that have been accredited by a New York approved jurisdiction may apply those credits towards their New York continuing legal education requirement. not eligible for accreditation by the New York State CLE Board.
New York Approved Jurisdiction Policy:
Procedures: An out-of-state course or program accredited by a New York "approved jurisdiction" shall be eligible for New York credit to the same extent as in the approving jurisdiction based on a 50-minute hour. The provider shall furnish the attorney with current documentation of the course or program approval by the CLE agency of a New York "approved jurisdiction" and shall provide the attorney with a certificate of attendance indicating: (1) proof of the program’s accreditation by one of the approved jurisdictions on the enclosed list; and (2) a certificate of attendance indicating the attorney’s name, the course title, time, date and location of course, the categories of credit and the number of CLE credits earned based on a 50-minute hour.
Newly Admitted Attorneys: If an attendee is a newly admitted attorney in New York (within his/her first two years of admission to the New York bar), the attorney is eligible to earn CLE credit only for attending transitional or introductory-level courses in a live classroom environment. Newly admitted attorneys may not earn credit towards their New York requirement through nontraditional formats (e.g., teleconferences, videotapes, audiotapes, interactive computer, motion picture presentations, self-study, correspondence work) during their first two years of admission to the New York bar. Therefore if your course is not designated as transitional, and/or if it does not take place in a live classroom setting, newly admitted New York attorneys may not earn credit towards their New York requirement for their attendance at your course.

  • The purpose of Section 100.10 is to provide a basis for an objective determination of substantial equivalence. A home instruction program that adheres to the standards of Section 100.10 at each stage of the process should be deemed substantially equivalent.
    Students instructed at home are not awarded a high school diploma. A high school diploma may only be awarded to a student enrolled in a registered secondary school who has completed all program requirements set by the Regents, the school or the district.
    Home-instructed students are not eligible to participate in interscholastic sports. Section 135.4(c)(7) of the Regulations of the Commissioner of Education, which governs interscholastic sports, directs that a participant in interscholastic sports must be enrolled in the school.
    Districts are not required to loan textbooks to home instructed-students. A student instructed at home is not enrolled in a nonpublic school, and, therefore, the district is not obligated to loan those items which a district is required to provide, by statute, to children attending nonpublic schools. However, a school district may, if it wishes to, provide textbooks and other materials to students instructed at home.

Union urges state to clarify access for SRPs January 29, 2003 Should bus drivers be informed of accommodations in a student's IEP? New York's lawmakers think so, but emergency regulations adopted by the Board of Regents have been excluding some School-Related Professionals in the name of confidentiality. A law passed last summer requires special and general education teachers, related service providers and other service providers to be provided with a copy of a student's Individualized Education Program before the program is implemented. The State Education Department is charged with drafting the regulations on the law's implementation. New York State United Teachers is working with the department to include paraprofessionals, who were excluded from the group of individuals eligible to receive a copy of the IEP in emergency regulations passed at the December Regents meeting. An IEP, designed to provide a student with a disability an appropriate education, details accommodations, supports and services needed for the child to succeed. Implementing the IEP is sometimes complicated if the necessary people are unaware of what the plan contains. NYSUT is working with the SED on revising the existing regulation to ensure paraprofessionals, including teacher aides and teaching assistants, receive information they need to implement the student's program.
