Souter said in trying to discover some overriding principle in the highest court's previous decisions. Other justices called the process of defining where to draw the line of permissible subsidies nearly impossible. The Louisiana case could determine whether federal plans to connect every American classroom to the Internet can include parochial schools and could impact future decisions regarding school-choice policies and tax vouchers for tuition. Most observers said Justice Antonin Scalia appeared the most sympathetic to allowing such public funding; Souter and John Paul Stevens the most skeptical. Sandra Day O'Connor and Anthony M. In 1982 Susie Phipps went to court to have her racial designation changed from "colored" to "white." Phipps, who looked white and thought of herself as white, had been declared "colored" under a 1970 Louisiana statute that made anyone with 1/32 or more "Negro blood" legally black. Although Phipps lost her suit, the 1970 statute was repealed a year later. This case is only one recent indication of just how important racial identity has been in Louisiana for more than two hundred years. Dramas of racial, ethnic, and regional identity have defined Louisiana history and society, and have played an essential role in works by Louisiana writers like George W. Cable, Kate Chopin, Ernest Gaines, Tim Gautreaux, Sybil Kein, and Brenda Osbey as well as in many works about Louisiana by writers such as Charles Chesnutt, Harriet Beecher Stowe, and Alice Jones. The goal of this Institute is to explore the interconnections among race, region, and identity through an examination of the literature, art, history, and music of the region. Vouchers, since they involve direct government funding of private school tuition, violate the Constitution whenever the private school involved uses this money to pay for religious instruction. Since the passage of the 14th Amendment the Supreme court has gradually made most of the Bill of Rights applicable to the states. The states, in other words, must now obey the guarantees embodied in the Bill of Rights, including the Constitutional prohibition against establishment of religion. This article explains the history of Supreme Court decisions relevant to school vouchers since the passage of the 14th Amendment. Briefly, our position is that, even though the Supreme Court has not gone far enough in enforcing the prohibition of religious establishment (note our criticisms below), there is no question that, on the basis of the law, voucher systems and other schemes for providing direct financial aid to religious schools are unconstitutional.
