    New Law Extravaganza!
    By: The Employment Law Department Governor Davis and the California legislature have been busy. Currying favor with voters and various lobbying groups, Governor Davis signed into law significant legislation just prior to the last election. What follows is a brief summary of the most important laws, as well as a description of the few bills which fell prey to Governor Davis' veto power. Background Investigations: Assembly Bills 1068 and 2868, which became effective on October 28, 2002, clarified and revised prior amendments to the California Credit Reporting Act and the Investigative Consumer Reporting Agencies Act. The new law allows employers to obtain a written waiver from having to provide job applicants and employees with copies of any public records obtained in connection with an investigation or background check conducted by in-house personnel. Further, no disclosure is required when an employer is conducting its own investigation into suspected misconduct. However, in the event that the employer takes any adverse action as a result of any public record, a copy of the record must be provided regardless of any prior waiver. The law omits general reference information obtained directly by an employer which is not a matter of public record. Paid Family Leave: The highly publicized Senate Bill 1661 had the effect of making California the first state to provide paid family leave. The new law gives up to six weeks of paid leave to California employees who cannot work due to the sickness or injury of a family member or in connection with the birth, adoption or foster care placement of a new child. No benefits will be paid during the first seven days of a covered leave, and employers may require the worker to use up any earned but unused vacation time prior to collecting benefits. As with existing state and federal leave law, medical certification may be required. The law is to be funded entirely by employee contributions and is not scheduled to take effect until January 1, 2004.

    Alumni are welcome to schedule career planning and job search counseling appointments with our staff. We find that alumni schedule appointments for a variety of reasons, including planning for transition to another career direction, interview and resume preparation, advice on a continued job search, and seeking information about opportunities of particular interest to them. Alumni are encouraged to call or stop by the Career Services Office to schedule an appointment. When scheduling appointments, please keep in mind the following tips:
    • Call well in advance to schedule an appointment. We fill up very quickly for middle and late August, early September, and early November appointments, so please plan ahead.
    • The Office is open during the summer, during the holiday break between semesters, and during semester break in the spring. We encourage you to take advantage of one of our less hectic periods.
    Reciprocity
    Career services professionals understand that looking for a job, be it the first job or a change to another one, is a stressful activity. To help ease the stress, NALP member law schools support a policy of providing job search assistance to students and graduates of other schools through reciprocity. Reciprocity is a mutual exchange of privileges. This allows law schools to provide reasonable access to their career resources for law students and graduates from other law schools that agree to provide similar services.

    ADDENDUM Since The Americans with Disabilities Act: Your Responsibilities as an Employer was published, the Supreme Court has ruled that the determination of whether a person has an ADA "disability" must take into consideration whether the person is substantially limited in performing a major life activity when using a mitigating measure. This means that if a person has little or no difficulty performing any major life activity because s/he uses a mitigating measure, then that person will not meet the ADA's first definition of "disability." The Supreme Court's rulings were in Sutton v. United Airlines, Inc., 527 U.S. (1999), and Murphy v. United Parcel Service, Inc., 527 U.S. (1999). As a result of the Supreme Court's ruling, this document's guidance on mitigating measures, found in the section "Additional Questions and Answers on the Americans with Disabilities Act," is superseded. Following the Supreme Court's ruling, whether a person has an ADA "disability" is determined by taking into account the positive and negative effects of mitigating measures used by the individual. The Supreme Court's ruling does not change anything else in this document. For more information on the Supreme Court rulings and their impact on determining whether specific individuals meet the definition of "disability," consult the Instructions for Field Offices: Analyzing ADA Charges After Supreme Court Decisions Addressing "Disability" and "Qualified," which can be found on EEOC's website at
