Subject: Your Memorandum re Walker v. West Campus Bookstore I have reviewed the memorandum you submitted in the matter listed above and am returning it to you for additional work. While I have made extensive comments in the margins, I think it useful for me to share with you in greater length my reasons for concluding that your memorandum is only marginally acceptable. I realize you are new to the firm and are just beginning your legal career. I offer this advice for the purpose of helping you realize the potential we recognized in you when we asked you to join our legal team. The draft you have submitted simply does not reflect your considerable talents. I have no doubt that your next draft will be substantially better and my fond hope is that over the course of the next several months your performance will provide me the confidence, which I do not yet have, to entrust more complex and challenging legal matters to your care. As you try to earn that confidence, you would do well to bear in mind the following points when preparing your legal writings.

Legal Matters
In North America, the handling of Wills and estates comes under the authority of the state and provincial governments. Procedures and requirements differ for each jurisdiction. Your own role and duties will depend on several factors: your relationship to the one who died; whether or not there is a Will; whether or not you are an executor; whether or not the Will goes to probate; whether or not you use a lawyer; and how simple or complex the legal and financial affairs are.
Find all the important papers
Go through all the likely places where important papers and records might be stored. Check the obvious spots, such as desk drawers and filing cabinets. Then check places like the stationery drawer in the kitchen or buffet cupboard, the basket on the counter that holds unpaid bills, the glove compartment of the car, wallets and purses, in the workshop, den, even in coat and jacket pockets.

Find two examples of doublets or triplets in your apartment lease, mortgage, car-loan agreement, or other personal contract. Suggest a revision that eliminates the redundancy without (in your opinion) changing the meaning. If you're part of a writing group or class, bring a copy of the before-and-after versions for each colleague.

Matters of Style
A Cranky, Opinionated Guide
by Brad Wendel, Assistant Professor of Law,
Washington and Lee University School of Law
These guidelines are drawn from several sources, including The Merriam-Webster Dictionary of English Usage (1989); Bryan A. Garner, A Dictionary of Modern Legal Usage (2d ed. 1995); Richard C. Wydick, Plain English for Lawyers (3d ed. 1994); Mark Herrmann, How to Write: A Memorandum from a Curmudgeon , 24 Litigation 3 (Fall 1997); Fifth Circuit Judge John Minor Wisdom's style guide for law clerks; Litigation Elements of Style , click on this link .) I have made some personal judgment calls in preparing this section, so don’t assume that all these authorities necessarily agree with what I tell you here. There are as many lists of legal style guidelines as there are books on legal writing, and there are even more articles in which the author rants and raves about some pet peeve in writing. (My own legal writing professor actually threatened to fail any submission in which "judgment" was misspelled as "judgement." For some reason that particular error drove him to distraction.) This list is not intended to be exhaustive, but it covers the most egregious writing sins that I've seen committed by practicing lawyers. I will enforce these guidelines on your written assignments. Acronyms . Some legal writers seem to think that the use of acronyms imparts their language with algebraic precision. Instead, their writing looks more like computer code or a Pentagon procurement manual than well written prose. Consider this example from the facts section of an actual brief filed in the Ninth Circuit:
