FOR MORE INFORMATION ABOUT ERIC, CONTACT ACCESS ERIC 1-800-LET-ERIC Since the Marshall Court in the early nineteenth century, the U.S. Supreme Court has issued a single opinion indicating its decision in a case. The Court disposes of each case it reviews by majority rule (typically either affirming or reversing) and provides a rationale for its decision. The disposition and rationale are both critical elements of the Court's decision. In providing reasons for its decision, the Court may offer constitutional interpretations which have a significant impact on American law and society. Moreover, what often makes Court cases compelling as human drama is that they typically involve real people engaged in disputes which have been brought to the justice system for resolution. This is the "disposition" of a case. In cases where some justices do not agree completely with the Court's decision, they may write or join concurring and dissenting opinions. In "concurring" opinions, justices agree with the majority regarding the outcome of the case, but disagree, in some way, with the reasons that support the outcome. In "dissenting" opinions, justices disagree with the outcome of the case and present rationales for their views. Justices offer reasons for their decisions based upon their understanding of law, history, and policy.

*** Top of Page 292 *** While Bass contends that only liberal states have legal norms that significantly impact their foreign policy, he admits several serious flaws that keep even the most creditable ones from fully prosecuting war criminals. Political necessity forces them to protect their own soldiers, regardless of the cost to their legal intentions or foreign populations, and similarly to appraise criminality against their own citizens much more highly than crimes against foreigners. Public outrage and pressure from non-governmental organizations are political necessities for successful trials, and do not always occur across the populations of even liberal states.     The Memory of Judgment. Making Law and History in the Trials of the Holocaust. By Lawrence R. Douglas, Associate Professor of Law, Jurisprudence and Social Thought. New Haven: Yale University Press, 2001. 318 pp. $35 hardcover.
    New York Review of Books (March 14), if the Holocaust lesson "never again" means Germans should never again be allowed to kill Jews in Europe in the 1940s, it makes it all too easy for governments, including the American government, to overlook more recent large-scale slaughters of Cambodians, Kurds, Bosnians, or Tutsi as somehow not measuring up to the horrors of the Holocaust, and then judge it not worth the political cost of intervening to stop them.
    At one level, this eminently readable book is about the primary obligation of the law, as understood in the democracies where these trials have taken place, to render legal justice. Among other things, the term means to guarantee fundamental rights of the accused to hear the charges in open court and defend himself against them with the aid of counsel, including by confronting or challenging witnesses and evidence, and that the court's conduct or the procedure used in the trial is explicit and fair.

    The other project is a study of the Leopold-Loeb trial. I have been working with Kathy Jones and Janet Tighe to produce an edited version of the trial transcript and write an introduction that explores that legal, medical, and social significance of the trial. The project grew out of teaching I did with Warren Susman many years ago on famous trials and out of Gerry Grob's successful efforts to interest me in the legal problems associated with insanity.
