Abuse in the Catholic Church Section: Abuse in the Catholic Church "There is a very fine line to that," said Milwaukee attorney Nathaniel Cade Jr., a member of the State Bar of Wisconsin's ethics committee. Cade said that, generally speaking, an attorney has the right to tell an opposing attorney that certain actions could border on criminal behavior. But it would be wrong to use a threat of possible criminal charges in an attempt to stop a lawsuit from being filed, he said. How Matthew Flynn, the attorney for the Milwaukee Archdiocese, may have raised the possibility of criminal charges during negotiations with Paul Marcoux's attorney is the key. Lawyers may not "threaten to present criminal charges solely to obtain an advantage in a civil matter," a state Supreme Court rule says.

Request for Legal Ethics Opinion (13.5 K) LEOs are written based on a hypothetical set of facts presented by the requesting attorney and reflect the judgment of the committee.
