The system of government is based on the laws of Islam, the faithful execution of which is assured under the concept of the valiy-e faqih, or the guardianship of a religious jurist. The faqih is the supreme spiritual leader and is chosen for his knowledge of Islamic theology. He is considered to be the representative of the Twelfth Imam and as such has final authority in all executive, legislative, and judicial matters. The faqih is elected for life by an Assembly of Experts (jurists). If no individual is able to fill the position, a Council of Leadership of three to five theologians in established, subject to popular approval.

    A chilling document that details recent troubling moves by the fundamentalist Iranian government has been forwarded to GayToday by Homan, the worldwide organization founded to protect gay men and lesbians within the borders of the Islamic Republic of Iran. It quotes Mohammad Gilani, Iran's chief prosecutor who said: " Set up a fire and throw the person who commits homosexual acts into the fire." Article 5 of the Declaration of Human Rights explains, says the document, that " Nobody may be tortured or punished in an inhumane or cruel way." In recent months, however, the world has witnessed vicious and barbaric crimes in Iran, including the mass-murder of women in Mashad and Tehran and the public floggings of youths in streets. These cruel acts have the full support of fundamentalist Iranian authorities. Hashemi Shahroodi, chief Justice of Iranian regime has announced that these attacks are taking place because of a formal command that has been issued by the Supreme Leader of Islamic Republic, Ali Khamenei. Mohammadi Gilani notes that the Supreme Leader ordered such cruelty in his Thursday night weekly meeting with the Iranian chief justice. In addition, Iranian police have added eight articles to their agenda to serve as new strategies to carry out these cruel acts against Iranian citizens. Their so-called "anti-corruption" agenda began on 2001/8/20.

    In the largest antigovernment protest since the Islamic Revolution in 1979, nearly 10,000 iranians defied a ban against public demonstrations and marched to the gates of Tehran University on Tuesday. After their orders to disperse were ignored, police fired tear gas into the crowd and arrested scores of demonstrators, mostly students.     GOVERNMENT
    The president of the republic is elected by universal suffrage to a 4-year term by an absolute majority of votes and supervises the affairs of the executive branch. The president appoints and supervises the Council of Ministers (members of the cabinet), coordinates government decisions, and selects government policies to be placed before the National Assembly.
    The National Assembly consists of 290 members elected to a 4-year term. The members are elected by direct and secret ballot. All legislation from the assembly must be reviewed by the Council of Guardians. The Council's six lawyers vote only on limited questions of the constitutionality of legislation; the religious members consider all bills for conformity to Islamic principles.
    In 1988, Ayatollah Khomeini created the Council for Expediency, which resolves legislative issues on which the Majles and the Council of Guardians fail to reach an agreement. Since 1989, it has been used to advise the national religious leader on matters of national policy as well. It is composed of the heads of the three branches of government, the clerical members of the Council of Guardians, and members appointed by the national religious leader for 3-year terms. Cabinet members and Majles committee chairs also serve as temporary members when issues under their jurisdictions are considered.
    Judicial authority is constitutionally vested in the Supreme Court and the four-member High Council of the Judiciary; these are two separate groups with overlapping responsibilities and one head. Together, they are responsible for supervising the enforcement of all laws and for establishing judicial and legal policies.

    January 9, 1998 Web posted at: 1:57 p.m. EST (1857 GMT) From State Department Correspondent Steve Hurst WASHINGTON (CNN) The Clinton administration recently sought to open a government-to-government dialogue with Iran , sources said, sending a secret letter to Iranian President Mohammad Khatami through diplomatic channels in the second week of August. Speaking on condition of anonymity, the sources said Iran did not reply through those same channels, but U.S. officials viewed Khatami's moderate statements about respect for the American people, made last month and again in a CNN interview this week, as the answer to the U.S. overture. Washington severed ties with Tehran after radicals there took 52 Americans hostage in 1979, holding them for 444 days. The letter to Iran, sources said, contained no provisos and simply asked the Iranians if they were ready to conduct talks with the United States. The sources said such a letter would have been signed by U.S. Secretary of State Madeleine Albright. It was written, they said, after a long administration debate in which one camp argued that Washington should wait for Iran to make the first approach.
