    COURSE DESCRIPTION
    This course will address some of the issues associated with the governmental regulation of international trade, through a problem oriented approach. At least two regulatory systems will be considered in almost every problem, one being the regulatory regime embodied in the domestic law of the country of import or export, and the other being the system of international agreements (such as WTO/GATT and NAFTA) that are intended to limit the actions which may be taken by individual governments. The impact of "globalization" within this framework will also be considered. Three major areas will be explored (1) tariffs and non-tariff barriers to trade, (2) domestic responses to import competition, and (3) trade regulation and international economic relations. These are topics which potentially concern any business dealing internationally, from global multinational corporations to small start-up ventures desiring to expand abroad.

Brief Historical Background 2.1 National Labor Bodies National union bodies developed in tandem with and, especially in continental Europe, as subordinate to national movements advocating socialism or social democracy; the major exception was Britain where the Trades Union Congress (TUC) preceded and then created its political arm, the Parliamentary Labour Party. International communication helped to strengthen international linkages; dramatic events, like the 1886 Haymarket bomb in Chicago and the subsequent prosecution of anarchists accused of responsibility, stimulated international campaigns and solidarity. As unions developed, their need to address concrete issues of wages, hours and fair treatment led to separate institutions with their own structures, leaders and priorities, leaving to socialist organizations the question of revolutionary strategy on the one hand, or the struggle to build nationally effective political and parliamentary organizations on the other. The Second International, stimulated by Haymarket, was largely dominated by the socialist parties of Germany, Austria, and Sweden, already developing a wide range of activities, newspapers and programs for workers and the larger public. Like most other efforts it failed to survive World War I.

    The Association has signed a cooperation agreement with FIEC – the European Construction Industry Federation. The Association maintains close relations with CICA – the Confederation of International Contractors' Associations. The Association is a member of the International Housing Association (IHA), which has as members building organizations worldwide. The Association has established a Forum for the Promotion of International Businesses, which will collect and distribute information about related issues as well as business opportunities. More and more Israeli companies are entering into joint ventures with foreign-held companies in order to facilitate construction projects in a growing number of countries, across every continent.     The Traditional View
    The usual research practices in jurisprudence express the idea that each legal system, be it Dutch law, French law, European Community law or international law has its own particular structure which delimits it from other legal systems. Studies focus on one such legal system, or compare one system with another, but always on the assumption that legal rules by definition form part of one particular legal system. As legal relationships are defined as relationships defined by legal rules, these also belong to a particular legal system.
    This view also assumes that legal systems only relate to one other 'externally'. As states are legal subjects in relation to international law, their legal relationships under international law may give rise to obligations affecting their internal legal systems. The creation of such obligations depends on the states' constitutional rules on concluding, approving and ratifying treaties, and they are the outcome of the choice made in constitutional law between direct applicability and implementation by legislation. Relationships do therefore exist between the legal systems, but they cannot be reduced one to another or reduced to one overarching legal system.
    A similar phenomenon may be observed in the relationship between national legal systems. There are no international rules of law for international contracts, marriages and adoptions; rather each national legal system has rules to establish whether the law of that jurisdiction or another should be applied.

    The interconnectedness of international and national labor law and social security law
    Over the last decades, the law of the European Union has become increasingly important for national legal systems. There have been some very significant developments in the fields of employee participation, working conditions, equal treatment of men and women, and the free movement of employees. As a result, many of these subjects can no longer be described purely in terms of national law.
    The Ph.D.-project on 'Protection of property rights in social security', to be carried out in the research group of labor law and social security law, fits into this research project. The same applies to the project on 'Implementing the EC directive on posting', which will also be carried out in the group of labor law and social security law (by Mijke Houwerzijl).

    Peace movement veterans and historians have never seen anything like it - a huge U.S. antiwar movement to stop a war before it starts. The big demonstrations, of course, constitute the most obvious example of this unprecedented phenomenon. But there are many other evidences as well. For example, 52 cities and towns including Chicago and San Francisco (as well the Mid-Hudson's New Paltz and Woodstock, N.Y.) have gone on official record opposing President Bush's intention to launch a war. Another 70 cities are considering antiwar resolutions and more are getting involved every day. And at what other time since it was formed over a half century ago particularly in contrast to the AFL-CIO leadership's deplorable stance during the Vietnam War has the U.S. labor federation raised so many questions and doubts about supporting a new war ? On Jan. 30, for example, John Sweeney, president of the AFL-CIO, and John Monks, general-secretary of the Trades Union Congress of Great Britain, jointly appealed to President Bush and Prime Minister Blair to take every possible step to achieve the legitimate ends of disarming Iraq without recourse to war.
