The Felix consent decree is the outcome of a 1993 lawsuit in U.S. District Court that alleged that "qualified handicapped children" were not receiving mental health services necessary to enable them to benefit from their education. The State waived all rights to appeal and agreed to fully implement a system of care by June 30, 2000. The State agreed to the consent decree to preserve its autonomy and maintain control in the design and implementation of a system of care. Star-Bulletin A federal judge's ruling that lets the parents of a special-needs student sue the state for out-of-pocket expenses and punitive damages may open a "Pandora's box" of baseless lawsuits, a state lawmaker said yesterday. U.S. District Judge David Ezra ruled on Wednesday that Patricia and Guy Nahale may proceed in their suit seeking to force the state to pay for therapy for their 6-year-old daughter, Amber, who is autistic and requires 20 hours of services a week. The Nahales also have an autistic son. The complaint argues for lost wages, emotional distress and punitive damages. Ezra rejected the state's argument that individual families were not allowed to sue because they already had their chance under the initial federal suit filed in 1993. That class-action suit filed on behalf of Jennifer Felix claimed the state violated federal law by failing to provide adequate services to special-needs students. Costs for the resulting Felix consent decree, which aims to improve mental-health and educational services, have soared to $350 million for 11,000 children from $45 million for 4,000 children in 1995. The state had argued that the decree precluded individual lawsuits, such as the Nahales'.

    Based on the AFT criteria for effective charter legislation, this report analyzes the legislation in 25 states. These criteria reflect accessibility to all students, high academic standards, standardized methods for assessing student performance, collective bargaining agreements for staff, certification of teachers, approval of local school districts, and reporting requirements. None of the state laws met all of the criteria. Although special education was not identified as a particular point of analysis, it was addressed in several of the criteria. For example, effective legislation should start with explicit language that ensures participation of all public school students. Schools that target students on the basis of academic or athletic ability are risking discrimination against students with disabilities. Likewise, schools that recruit "at-risk" students are not inclusive if the definition of "at-risk" is vague. Strategies for assessing student performance need to be adapted to reflect the unique learning styles and curricular needs of students with disabilities. School reporting should include student demographics that reflect the special needs of its students.

Today's meeting is the latest in a series of public meetings Abercrombie has held with Hawaii educators, U.S. Education Secretary Richard Riley, and other state and federal education officials regarding Hawaii's school, construction, repair and renovation needs. Abercrombie presented Vice President Gore with the results of a survey he conducted among Hawaii public school principals regarding their schools' infrastructure needs. The survey results highlights three areas of widespread concern: Overcrowded classrooms: Survey respondents have an average 27:1 student-teacher ratio. Abercrombie agrees with Hawaii principals that the federal government should step in to help hire more teachers. The survey also shows that being forced to use "temporary" portable classrooms is a big problem. Some "temporary" facilities have been in use for 40 years. School modernization : Principals are very concerned about the need to bring their schools into the modern computer, telecommunications and electronic era. Also, as recent news stories have indicated, many schools need air conditioning so that students and teachers can function in a livable learning environment.

The nearly 10-year odyssey of trying to bring Hawaii's special-education system into compliance with federal law is winding down with a crucial court-imposed deadline slated for next month. "Right now, I am optimistic that they are going to be at least in substantial compliance. That has a fairly reasonable probability of being true," said Ivor Groves, appointed by the federal court to monitor the state's progress in meeting benchmarks set out in the Felix consent decree. But Groves and others also acknowledge that not every school in the state will satisfy the necessary mandates on time, meaning some schools may have to take corrective action past the March 31 deadline. "It is not inconceivable that we could end up with (school) complexes that aren't quite there," Groves said this past week. That realization, along with other lingering challenges in providing educational and mental health services to special-needs students, leave some wondering whether being deemed "in compliance" really means the schools are in compliance. "They are, in actuality, not in compliance," contends parent advocate Naomi Grossman. "It's only paper compliance."

Building a picture of school safety in Hawaii is difficult, but many people are concerned. TOMORROW
Schools are working to beef up security and head off violence on campuses. WEDNESDAY
Alternative education programs attempt to rehabilitate problem students.
Jonathon Harding was left with a broken jaw after a handful of boys assaulted him at Pearl City High School on May 25. Nearly one year later, it still hurts to eat and talk. Jose Abrante III also had his jaw broken during a campus beating. Two boys attacked him at Kalaheo High on March 9. Afterward, he fed himself by mashing clam chowder through the wires that held his mouth shut. Whatever the number of incidents, many worry that their ferocity is up. Some suspect more is going on than has been reported. And they question if schools are prepared. Kohala High and Intermediate senior Marsha Torres said she always has felt safe at school, until recently when she heard a fellow student was threatening to bomb the school.
