juvenile justice: an overview
Juvenile justice is the area of criminal law applicable to persons not old enough to be held responsible for criminal acts. In most states, the age for criminal culpability is set at 18 years. Juvenile law is mainly governed by state law and most states have enacted a juvenile code. The main goal of the juvenile justice system is rehabilitation rather than punishment. Juveniles can be transferred into adult court if the juvenile court waives or relinquishes its jurisdiction. State statutes creating juvenile courts and providing methods for dealing with juvenile delinquencey have generally been upheld by courts as an acceptable extension of state police power to ensure the safety and welfare of children. The doctrine of parens patriae authorizes the state to legislate for the protection, care, custody, and maintenance of children within its jurisdiction. The federal role in the field has largely been that of funder and standard setter. Congress passed the Juvenile Delinquency Prevention and Control Act in 1968. This was later revised in 1972, and renamed the Juvenile Delinquency Prevention Act. The stated purpose of the act is to assist states and local communities in providing community based preventative services to youths in danger of becoming delinquent, to help train individuals in occupations providing such services, and to provide technical assistance in the field.

  • Rosanne McInnes is a stipendiary magistrate in Adelaide, South Australia. In January 1994, the Adelaide Youth Court began to administer the implementation of new juvenile offender legislation in all major metropolitan court areas, with the exception of the Port Adelaide court area. Rosanne McInnes was transferred to the Port Adelaide Magistrates Court, where she was responsible for implementing the new legislation until the Adelaide Youth Court was able to take over, in April 1994. At Port Adelaide, she used Family Conference as a sentencing option.
  • Sue Hetzel was the Senior Youth Justice coordinator who introduced Family Conference into options for dealing with juvenile offending in South Australia, under the new legislation. She has a private social work practice, which provides private counselling and conducts human resources management education programmes. The material for dealing with the role of the conference coordinator is extracted from a chapter Sue Hetzel has contributed to a book about Family Conference around the world, which is being published in the USA in early 1996. The editors are Hudson, Galloway, Morris, and Maxwell, who are based at universities in Canada.

    November 1995 In the District of Columbia, the average child in the delinquency system has fallen a minimum of two school years behind his peer group in terms of actual school placement, and is a minimum of three to four years behind in terms of academic achievement. The majority of children entering the juvenile delinquency system in D.C. have learning disabilities, emotional disturbances or mental retardation. Unfortunately, the professionals who deal with these children, namely, judges, probation offices, juvenile prosecutors and defense attorneys, typically lack the training to recognize these problems, and are unfamiliar with special education law. Joseph Tulman, Associate Professor of Law and Director of the Juvenile Law Clinic at the District of Columbia School of Law, contends that lawyers who can discern learning disabilities in their clients can enhance the effectiveness of their representation in many ways, in his article, The Best Defense is a Good Offense: Incorporating Special Education Law into Delinquency Representation in the Juvenile Law Clinic. "Children with learning disabilities, emotional disturbances and mental retardation do not always understand their legal rights completely; lawyers can try different methods of communicating with their clients, or have a guardian ad litem look out for the child s best interests. An understanding of special education law can help an attorney hone her approach to the case."

    HOUSE BILL 677 HOUSE AUTHOR: Solomons EFFECTIVE: SENATE SPONSOR: Haywood House Bill 677 amends the Transportation Code and the Family Code to allow a court to order a person younger than 21 years of age to perform eight hours of community service for the first offense of selling, manufacturing, distributing, or possessing a document that is deceptively similar to a driver's license. This community service is in addition to any other punishment and can only be ordered if the court is located in a municipality or county that has established a community service program.
