The problem, explained Catlett founder of Junkbusters and a participant in a Commerce Department meeting Tuesday on Internet privacy and ecommerce is that his mom has decided the Internet is no place for private citizens.

Her concern stems from precisely the quality that makes the Web so attractive to 21st century marketers: its ability to track her electronic whims. As she explained to her son, "I had thought that surfing the Web was like watching TV, that no one was watching when I changed the channel." The reason the Clinton administration has taken an interest in the Internet, of course, is that it isn't like TV at all. Television created a new form of entertainment, changing the way generations of viewers experienced the world and news. But the Internet is another order of magnitude.

The Future of the Commerce Department

INTRODUCTION
I want to thank the committee for the opportunity to testify today on the future of the Commerce Department. I believe that Commerce should be shut down. I maintain that:
  • First, the few legitimate functions of this department should be transferred to other departments; Second, agencies and offices performing functions not appropriate for government either should be shut immediately or phased out, with special attention given to technology policy, and; Third, these are necessary steps if this country is to restore a system of limited government, rule of law, and free markets, avoiding the regime crises now facing other industrialized, democratic countries.
I. WHAT TO KEEP
Two functions of the Commerce Department are allowed to the federal government by the U.S. Constitution and thus there is a prima facie case for retaining a federal role. The Census.

The site is the result of a partnership between Northern Light Technology and the National Technical Information Service (NTIS). The administration asked for a review of gov.search, and requested that all fees be waived until further notice. 06:12 PM May. 08, 1997 PT When the Commerce Department on Thursday gave its blessing to the export of the strongest available encryption products for electronic banking and finance, the Clinton administration wasn't really giving any ground on its stance on key recovery. That's because the likely customers for these products - banks and financial institutions - are already subject to tough rules when it comes to tracking transactions and accounts to individuals. And these institutions are legally bound to share this information with the authorities.

Given the scope of current regulation, the Commerce Department's key recovery requirement would only be duplicative, a department spokesperson said. That's why banks have been allowed to export government-approved Data Encryption Standard technology since the early 1980s. And that's why they'll now be able to use stronger encryption to secure transactions, including account and credit card numbers. The government standard has a fixed-key length of 56 bits; encryption being readied for electronic commerce such as Secure Electronic Transaction can have keys of 1,024 bits and longer. It is assumed that it would take years and enormous computing power to crack the longer keys.

(November 12, 2002) Just days after the American Jewish Congress called on the U.S. Department of Commerce to vigorously enforce legislation outlawing participation by U.S. firms in the Arab boycott of Israel, AJCongress has congratulated Undersecretary of Commerce Kenneth Juster, who, on behalf of the Department, has vowed to do just that. Juster announced last week that the Commerce Department "will use all of its resources to vigorously enforce U.S. anti-boycott regulations." AJCongress and Juster acted immediately following a recent meeting of the Arab League at which a decision was made to reinstate the boycott. In a letter to Juster, AJCongress President Jack Rosen wrote: "You have sent a clear message to American firms and the Arab world alike that the United States will not tolerate this vicious boycott, which attempts to cause grave damage to Israel through economic pressure, and thereby further diminishes the possibilities of peace in the Middle East." AJCongress has vowed to work closely with the Commerce Department in identifying any firms which participate in the boycott.

By Keith Perine Issue Date: May 01 2001 But privacy advocates say they're still waiting for the Bush administration to make good on campaign commitments to data security. WASHINGTON - U.S. Commerce Secretary Don Evans announced last week that he will hire a senior adviser for privacy matters for the Commerce Department. The adviser, who has yet to be named, will watch over the department's Internet system and privacy policies, according to a department statement. "Many Americans rely on the Department of Commerce Internet system for a wide range of statistics, data and other information," Evans said in the statement. "I recognize the importance of consumer privacy, and we should lead by example." Despite Evans' statement, privacy advocates are still waiting for the new Bush administration to make a more concrete demonstration of its commitment to data privacy protection. While on the campaign trail last year, President George W. Bush declared that privacy was an important issue. So far, though, his administration has concentrated on other matters, such as pushing for a $1.6 trillion tax cut.

It’s one of the reasons he joined the Air Force 18 years ago and still serves his country today as a member of the Air Force Reserve. It’s also one of the reasons he enjoys his civilian job as an electronics technician for the National Weather Service, where he travels to remote Kansas airports to maintain equipment. His interest in aircraft explains why Gill noticed an old Piper Tri-Pacer sitting near where he and another person were working last March at an airport in Russell, a small town in northeast Kansas. About an hour after noticing the aircraft, as the two worked out of the back of their vehicle, Gill heard what he described as a “loud thud.” “I looked around the corner of the truck and saw the plane upside down, its wings and propellers all bent up,” said Gill, a maintenance squadron master sergeant in the 931st Air Refueling Group at McConnell AFB, Kan. The two men immediately ran over to help the pilot, who was still trapped inside. The crash had bent the wings, which were blocking the doors from opening. They could smell gasoline as they pushed the fuselage away from the wings to remove the pilot, who was hanging upside down, held in place by his restraint system.

COMMERCE DEPARTMENT DETERMINES NO SIGNIFICANT ADVERSE IMPACT
OF FISHING ON DOLPHIN POPULATIONS NOAA Fisheries ) today announced its finding that the tuna purse seine industry practice of encircling dolphins to catch tuna has no significant adverse impact on dolphin populations in the Eastern Tropical Pacific Ocean (ETP). The finding clears the way for tuna caught under the terms of a binding multilateral environmental agreement to be imported into the United States with the dolphin-safe label, so long as no dolphins are injured or killed during the set in which the tuna are caught. Hogarth said that the United States would seek better enforcement of existing International Dolphin Conservation Program (IDCP) requirements and promote a strong package of improvements to the Program, including new requirements on a growing number of smaller vessels. As part of this commitment to dolphins in the ETP, NOAA Fisheries will continue to conduct research and monitoring on depleted dolphin stocks. Working with the IATTC and the Marine Mammal Commission, the agency will conduct annual reviews of the effectiveness of the IDCP and continue to develop conservation measures to recover depleted dolphins and maintain tuna stocks. NOAA Fisheries is expecting to fund research at approximately $3 million per year.

"I feel battered," said Truste executive director Susan Scott, leaving the podium after defending the group's year-old privacy initiative in a grueling Wednesday session with privacy advocates Robert Biggerstaff, Bob Gellman, Beth Givens, and Marc Rotenberg.

Whether or not the seal really means anything is in dispute. For the Commerce Department where responsibilities range from taking the census to predicting the weather, decentralization is the approach that works in F0IA administration. "It gives many people down the line in the programs the authority to grant access to records," says a Commerce official. "Of course, individual FOIA officers, policy specialists and attorneys give assistance .... Within a framework set by the department, bureaus have flexibility to use their own procedures for responding to requests. These will vary depending on volume and other factors unique to the bureau." "There is just no way that one Freedom of Information Office without a large staff could be effective in handling requests for information generated by a myriad of bureauseverything from Patents and Trademarks to the Bureau of Standards and the International Trade and the Maritime Administrations." "Besides variety, Commerce deals with many subjects that are highly technical and require substantive expertise on the part of officials deciding whether to release. It is just more efficient to handle FOIA requests at the program level," continues the official. Coupled with this decentralized approach is a high-level, highly visible information policy office. The Information Policy Division, part of the Office of Organization and Management Systems, reports to the Assistant Secretary for Administration. Headed by Marilyn S. McLennan, the five-year old policy division has departmentwide responsibilities for administering all openness statutes, including the Freedom of Information Act, the Privacy Act, the Federal Advisory Committee Act, and the disclosure portion of the Ethics in Government Act.

In recent weeks, the government has opened the business of registering Internet addresses ending in .com, .net, and .org to new competitors, terminating Network Solutions' five-year lock on the lucrative market.

But Herndon, Virginia-based Network Solutions has refused to allow other companies access to its full database of registered names, sometimes called the "whois" database. "We strongly object to NSI's restrictive policy," Commerce Department general counsel Andrew Pincus said in a letter to the company dated 23 July and released Monday. Referring to the company's 1993 agreement with the government to register names, Pincus said, "nothing in the cooperative agreement, nor in existing law, gives NSI the right to restrict access to this information."

Sun's deal includes one deliciously ironic twist: The US code-export policy is a national-security legacy of the Cold War, and the software that Sun plans to market was developed by a suburban Moscow software firm in which the California company has invested, Elvis+ Co.

Humphrey Polanen, general manager of Sun's Network Security Products Group, said Monday that the company was responding to "customers crying out for strong encryption" to help facilitate electronic commerce. He emphasized that Sun had no role in developing the Russian-developed software, called PC Sunscreen SKIP E+, but is merely using its worldwide network to get it to market.
